Affiliate Terms and Conditions

These Affiliate Program Terms and Conditions (the “Agreement”) govern participation in the CheckView Affiliate Program (the “Program”) operated by CheckView (“Company,” “we,” “us,” or “our”). By enrolling in the Program, you (“Affiliate,” “you,” or “your”) agree to comply with this Agreement in full. If you do not agree to these terms, you may not participate in the Program.

1. PROGRAM ENROLLMENT & ELIGIBILITY

1.1 Application Process

To join the Program, you must submit an application through the designated affiliate sign-up form. We reserve the right to accept or reject applications at our sole discretion. If your application is denied, you may not reapply without prior written permission.

1.2 Eligibility Requirements

By applying to the Program, you represent and warrant that:

• You are at least 18 years old or the legal age of majority in your jurisdiction.

• You operate a legitimate business, website, or marketing channel suitable for promoting CheckView.

• You agree to comply with all applicable laws, regulations, and industry standards.

• You will not use CheckView’s name, logo, or content in a way that misrepresents or harms our brand.

1.3 Approval & Ongoing Compliance

We reserve the right to review Affiliate accounts for compliance at any time. Failure to comply with this Agreement may result in suspension or termination of your Affiliate account.

2. COMMISSIONS & PAYMENT TERMS

2.1 Commission Structure

Affiliates will earn a 30% commission on each eligible sale made through their unique referral link. Commissions apply to both initial purchases and recurring subscriptions, provided the referred customer remains active.

2.2 Tracking & Cookie Duration

• CheckView uses cookie-based tracking to associate referrals with Affiliate accounts.

• Cookies last for 60 days, meaning referred users must complete a purchase within this period for the Affiliate to receive credit.

• If a customer clears cookies, uses a different browser, clicks on another affiliate’s link or does not use the affiliate link before purchasing, the commission may not be credited.

2.3 Payment Schedule & Methods

• Payouts are made on a monthly basis, meaning commissions earned in a given month will be paid 30 days after the close of that month.

• Payments are issued via Wise or PayPal. Affiliates are responsible for ensuring their payment details are correct.

• A minimum payout threshold of $10 USD must be met before payments are issued. Earnings below this threshold will roll over to the next payout cycle.

2.4 Refunds, Chargebacks & Commission Adjustments

• If a referred customer cancels their subscription, requests a refund, or initiates a chargeback, the associated commission will be deducted from future payouts.

• In cases of suspected fraud, abuse, or violation of this Agreement, we may withhold or reverse commissions at our discretion.

3. AFFILIATE RESPONSIBILITIES & PROMOTIONAL GUIDELINES

3.1 Permitted Promotional Methods

Affiliates may promote CheckView through:

• Content marketing (e.g., blogs, articles, product reviews)

• Social media and email marketing (provided all emails comply with CAN-SPAM, GDPR, and other applicable laws)

• PPC advertising (subject to restrictions below)

3.2 Prohibited Activities

Affiliates may NOT:

• Bid on CheckView-related terms in Google Ads, Bing Ads, or other PPC platforms without written permission.

• Use misleading, deceptive, or unethical marketing tactics, including false claims or unauthorized discounts.

• Engage in spamming, unsolicited emails, or intrusive advertising methods.

• Promote CheckView on websites with illegal, offensive, or inappropriate content.

• Impersonate CheckView or misrepresent your relationship with the Company.

3.3 Compliance with Laws & Regulations

Affiliates must adhere to all applicable laws and regulations, including but not limited to:

• Federal Trade Commission (FTC) guidelines regarding affiliate disclosures.

• General Data Protection Regulation (GDPR) for EU-based promotions.

• California Consumer Privacy Act (CCPA) for data privacy compliance.

Affiliates must clearly disclose their affiliate relationship in any promotional content, such as:

“This page contains affiliate links. If you purchase through these links, I may earn a commission at no additional cost to you.”

4. NON-COMPETE AGREEMENT

4.1 Restrictions on Competing Promotions

To maintain the integrity of our affiliate network, Affiliates may not simultaneously promote or act as an affiliate for competing automated WordPress testing or website monitoring services that directly compete with CheckView.

4.2 Approval for Exceptions

If an Affiliate believes they can fairly promote CheckView alongside a competing service, they may request written approval from CheckView. We reserve the right to grant or deny such exceptions at our discretion.

4.3 Violations & Consequences

If an Affiliate is found to be promoting a direct competitor without approval, we reserve the right to:

• Suspend or terminate the Affiliate account immediately.

• Revoke any unpaid commissions.

• Pursue legal action if necessary.

5. ACCOUNT MANAGEMENT & TERMINATION

5.1 Affiliate Dashboard & Reporting

Affiliates can track their referrals, commissions, and earnings in real-time via the CheckView affiliate dashboard. It is the Affiliate’s responsibility to monitor their performance and report any discrepancies.

5.2 Inactivity & Account Termination

We reserve the right to deactivate or terminate affiliate accounts in cases of:

• Inactivity for 12 months (no sales or engagement).

• Violation of these Terms & Conditions or legal non-compliance.

• Suspected fraudulent or unethical activities.

If an account is terminated for violations of this Agreement, any unpaid commissions may be forfeited at our discretion.

5.3 Modifications to Terms

CheckView reserves the right to update, modify, or terminate this Program at any time. Affiliates will be notified of any material changes, and continued participation constitutes acceptance of the revised terms.

6. LEGAL DISCLAIMERS & LIMITATIONS

6.1 Independent Contractor Status

Affiliates are independent contractors, not employees, partners, or representatives of CheckView. Participation in the Program does not create any employment or agency relationship.

6.2 No Guarantee of Earnings

CheckView does not guarantee any level of earnings, conversion rates, or program success. Affiliate commissions depend on factors including marketing efforts, customer actions, and market conditions.

6.3 Governing Law & Dispute Resolution

This Agreement shall be governed by the laws of the state of Georgia in the country of the United States of America. Any disputes arising from this Agreement shall be resolved exclusively in the courts of the state of Georgia of the United States of America.
